About consultants

What is an immigration consultant?

An immigration consultant is a non-attorney registered with the California Secretary of State under the Immigration Consultant Act (Business and Professions Code § 22440 and following). Consultants must pass a background check and file a $100,000 bond with the Secretary of State, which consumers can look up online.

The law limits what a consultant may do: complete government forms at your direction, translate your answers, obtain supporting documents such as birth certificates, submit completed forms, and refer you, without a referral fee, to an attorney.

A consultant is not an attorney and cannot give legal advice, decide what status you should apply for or how to answer questions, or represent you at USCIS interviews or in immigration court. Only attorneys and representatives accredited by the U.S. Department of Justice can represent you.
