When both spouses agree on property, support and custody, an uncontested divorce avoids a trial. One spouse must have lived in California for 6 months and in the filing county for 3 months. The marriage can end no sooner than 6 months after the other spouse is served.

What is the difference between an LDA and an attorney?

We prepare and file documents at your direction. We cannot give legal advice, interpret the law for you, or appear in court. Contested custody or property issues need an attorney.

We married in China. Can we divorce in California?

Yes, if one spouse meets the California residency requirement of 6 months in the state and 3 months in the county. Where you married does not matter; we can translate the Chinese marriage certificate.

Is a California divorce valid in China?

The judgment first needs a California apostille and a Chinese translation. To remarry or update household registration in China, a Chinese intermediate court usually must recognize the foreign judgment.

How long does a name change take?

Usually 3–4 months, including four weeks of newspaper publication before the hearing.
